These Terms of Use (“Terms”) govern your use of jobinary.com (“Jobinary”, “we”, “us”). By creating an account or using the site, you agree to these Terms. If you do not agree, please do not use Jobinary.

1. What Jobinary is

Jobinary is an online job board where private employers and domestic staffing agencies (“Employers”) post household and private staff jobs, and job seekers (“Candidates”) search and apply for them. Jobinary is not an employer, staffing agency or employment agency. We do not employ, screen, recommend or place candidates, and we are not a party to any agreement between Employers and Candidates.

2. Accounts

You must be at least 18 years old to create an account. You agree to give accurate information, keep your login details secure and tell us at [email protected] if you think your account has been used without permission. You are responsible for activity on your account. We may review, approve, suspend or close accounts at our discretion, including Employer accounts that we cannot verify.

3. Rules for Employers

  • Post only real, currently open jobs that you are authorized to fill.
  • Describe the role, pay, schedule and location accurately.
  • Never ask Candidates for money, gift cards, payment details or fees of any kind to apply or be hired.
  • Comply with all applicable employment, wage, anti-discrimination, privacy and background-check laws, including the Fair Credit Reporting Act and state law. Do not post jobs that discriminate on the basis of any characteristic protected by law.
  • Use Candidate information only to consider them for the job they applied to, and keep it confidential.
  • Agencies posting for clients are responsible for having their clients’ permission and for meeting any licensing rules that apply to them.

4. Rules for Candidates

  • Give accurate information in your profile and applications.
  • Apply only to jobs you are genuinely interested in.
  • You decide what personal information to share. Do not share your Social Security number, bank details or ID documents until you have a written offer and have confirmed who the employer is.

5. Prohibited conduct

You may not use Jobinary to post false, misleading, illegal or offensive content; harass anyone; send spam; collect other users’ information for purposes other than hiring; scrape the site; impersonate anyone; or interfere with the site’s security or operation.

6. Our review of content

We may review, edit, refuse or remove any job listing, profile or other content, and we may suspend accounts that break these Terms. Reviewing content does not mean we verify it or endorse any user. You are responsible for your own decisions about whom to hire or work for, including checking references and running any background checks the law allows.

7. Fees and payments

Employers and agencies pay for job posts with one-time packages. Prices and what each package includes are shown before you buy, and payments are processed by our payment provider, Stripe. Packages are not subscriptions and do not renew automatically. New employer accounts may receive one free job post. Because posts are used as soon as a job is submitted, payments for used posts are non-refundable; if something goes wrong with a purchase, contact [email protected] and we will review it. Jobinary is always free for Candidates.

8. Your content

You keep ownership of the content you post. You give us a non-exclusive, worldwide, royalty-free license to host, display and distribute it as needed to run and promote Jobinary. You confirm you have the right to post it.

9. Disclaimers

Jobinary is provided “as is” and “as available”. To the extent permitted by law, we make no warranties about the site, its content or its users, including the accuracy of job listings or profiles, or that any job will be filled or any Candidate hired.

10. Limitation of liability

To the extent permitted by law, Jobinary will not be liable for any indirect, incidental, special or consequential damages, or for any loss arising from your dealings with other users. Our total liability for any claim relating to Jobinary is limited to the greater of the amount you paid us in the 12 months before the claim or $100.

11. Indemnity

You agree to indemnify Jobinary against claims arising from your content, your use of the site or your breach of these Terms or the law.

12. Changes and termination

We may update these Terms. If we make material changes, we will update the date above and, where appropriate, notify you. You may close your account at any time from your dashboard.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
